1. Acceptance of Terms

By accessing or using CardDeals (the "Service"), operated at carddeals.co by CardDeals LLC ("CardDeals", "we", "our", or "us"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

CardDeals is a gift card marketplace and comparison platform. We help you save on gift cards in several ways:

• Comparison. We aggregate discounted gift card offers from third-party providers so you can find the best price. For those deals, the third-party provider fulfills the transaction.
• Buying cards from you (cash out). We purchase unused gift cards from you for cash. This is a sale of goods governed by our Gift Card Sale Terms.
• Selling cards directly. Cards we own may be sold directly to buyers on CardDeals, delivered electronically after purchase.

3. Account Registration

Some features of the Service require you to create an account. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms or appear to be fraudulent.

4. Use of the Service

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Scrape, crawl, or use automated means to access the Service without our written permission
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to transmit malicious code, spam, or harmful content
• Resell or redistribute the Service without authorization
• Upload, post, or transmit any infringing, deceptive, fraudulent, or defamatory content

5. Purchases & Our Guarantee

Cards sold directly by CardDeals. Some gift cards are sold to you directly by CardDeals and are clearly marked "Sold by CardDeals" at checkout. These purchases are covered by our money-back guarantee: if a card you buy from us does not work as described or its balance is incorrect, contact us at [email protected] within thirty (30) days of purchase and we will verify the issue and, at our discretion, issue a full refund to your original payment method or replace the card. The guarantee covers cards that are invalid, already redeemed, or carry a balance materially lower than advertised. It does not cover cards you have partially or fully spent, cards reported after the 30-day window, losses caused by sharing your card code with others, or buyer's remorse where the card is valid and matches its description. Refunds are typically processed within five (5) to ten (10) business days of approval.

Third-party provider deals. CardDeals also displays offers from third-party gift card providers. When you click through to purchase from one of these providers, you are interacting directly with that provider. Each provider has its own terms of use, return policies, and guarantees. For these deals CardDeals is not a party to the transaction and is not responsible for the quality, safety, legality, or delivery of gift cards purchased through linked providers; our money-back guarantee above applies only to cards sold directly by CardDeals.

6. Affiliate Relationships & Compensation

CardDeals may earn a commission when you purchase gift cards through certain provider links on the platform. Currently, CardCash is a paid affiliate partner, meaning CardDeals receives a referral fee on qualifying purchases made through CardCash links. No other providers on the platform pay CardDeals commissions at this time.

These affiliate commissions do not affect the price you pay for gift cards. The price you see on CardDeals is the same price offered directly by the provider.

CardDeals's comparison rankings and recommendations are based on objective factors such as discount amount, provider reliability, and availability. Affiliate relationships do not influence how offers are ranked or which providers are recommended to you.

7. Cookies, Analytics & Privacy Disclosures

Our Service uses cookies and similar technologies. Essential cookies (session management, consent preferences) are necessary for the Service to function. We also use Google Analytics and PostHog product analytics, including privacy-masked session replays on selected product flows, to understand usage patterns and improve our Service.

In compliance with applicable privacy regulations (such as GDPR in the EU/UK, LGPD in Brazil, and state privacy statutes including the California Consumer Privacy Act / CPRA in the United States), analytics and advertising measurement features are subject to your consent and opt-out preferences. We honor the browser-level Global Privacy Control (GPC) signal. You can withdraw, customize, or adjust consent preferences at any time using our Cookie Preferences settings.

8. Price Alerts

CardDeals offers price alert notifications as a convenience feature. While we strive to deliver accurate and timely alerts, we do not guarantee that alerts will be sent in real-time or that the prices shown at the time of notification will still be available when you visit the provider. Price alert notifications are informational only and do not constitute an offer or guarantee of any price.

9. User-Generated Content (UGC) & Community Guidelines

CardDeals may allow users to submit, post, or upload content, including brand reviews, ratings, deal feedback, comments, error reports, and gift card verification documentation such as receipts or card balance screenshots ("User-Generated Content" or "UGC").

By submitting any UGC, you represent and warrant that:

• You are the sole author and owner of the intellectual property rights in the content, or you have obtained all necessary licenses, permissions, and rights to submit it.
• Your submission does not infringe, misappropriate, or violate any third party's copyright, trademark, patent, trade secret, privacy rights, publicity rights, or other proprietary rights.
• Your submission does not contain false, fraudulent, defamatory, obscene, or unlawful material, nor does it contain viruses or malicious code.

License Grant: You retain ownership of your original UGC. However, by submitting UGC to CardDeals, you grant CardDeals LLC a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, display, reproduce, modify, publish, and distribute your content across our platforms in connection with operating and promoting the Service.

Moderation & Removal: CardDeals reserves the right, but does not assume the obligation, to monitor, review, edit, reject, or remove any UGC at any time, for any reason, with or without notice, at our sole discretion.

UGC Indemnification & Liability: You acknowledge that willful copyright infringement under United States law may subject infringers to statutory damages of up to $150,000 per infringed work (17 U.S.C. § 504(c)). You expressly agree to defend, indemnify, and hold harmless CardDeals LLC, its officers, directors, employees, and affiliates from and against any and all claims, liabilities, statutory damages, settlements, legal fees, and costs arising out of or related to any UGC you submit or upload.

10. Digital Millennium Copyright Act (DMCA) Notice & Takedown Policy

CardDeals respects the intellectual property rights of others and complies with the safe harbor provisions of the Digital Millennium Copyright Act (17 U.S.C. § 512). It is our policy to respond expeditiously to legitimate notices of alleged copyright infringement and to terminate accounts of repeat infringers.

Submitting a DMCA Takedown Notice: If you are a copyright owner or an authorized agent thereof and believe that material residing on or accessible through CardDeals infringes your copyright, please submit a written notification containing:

1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single site are covered, a representative list.
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and information reasonably sufficient to permit us to locate the material (e.g., exact URL or page link).
4. Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification: If you believe your content was removed by mistake or misidentification, you may submit a counter-notice pursuant to 17 U.S.C. § 512(g)(3) to our DMCA Agent containing your signature, identification of the material removed, a statement under penalty of perjury of good-faith belief of mistake, and consent to the jurisdiction of the federal district court.

Repeat Infringer Policy: In appropriate circumstances, CardDeals will terminate accounts or access for users who repeatedly infringe or are repeatedly charged with infringing third-party intellectual property rights.

11. Artificial Intelligence (AI) Features & FTC Compliance Disclosure

In compliance with Federal Trade Commission (FTC) guidelines regarding deceptive advertising, artificial intelligence substantiation, and consumer transparency, we clearly disclose our use of algorithmic and AI-assisted technologies:

• Algorithmic Deal Aggregation & Ranking: We use automated software algorithms and data processing to aggregate pricing, calculate discount percentages, compare gift card inventories, and rank deals based on objective metrics (such as savings and reliability).
• Substantiated Pricing (No "AI-Washing"): We do not fabricate, simulate, or deceptively inflate discount percentages or savings claims using generative AI. All displayed discount rates and provider offers are substantiated by actual live provider feeds, verified marketplace listings, and historical merchant data.
• Automated Processing & Verification: Where automated tools or optical character recognition (OCR) are used to extract card balance details from submitted receipts or card documentation, results are verified prior to payout or listing.
• User Data Protection in AI: CardDeals does not share confidential user payment information, banking details, full gift card claim codes, or personal credentials with public third-party AI models to train foundation models.
• Informational Disclaimer: Algorithmic suggestions and savings estimates are provided for informational and convenience purposes only. While we aim for high accuracy, you should always confirm the final purchase terms and price with the provider at checkout.

12. Intellectual Property

The Service, including its design, features, content, algorithms, and underlying technology, is owned by CardDeals LLC and is protected by copyright, trademark, and other intellectual property laws. Brand names, logos, and trademarks displayed on the Service belong to their respective owners and are used for identification and informational comparison purposes only. You may not copy, modify, distribute, or create derivative works based on our Service without our express written consent.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We make no representations regarding the accuracy or completeness of gift card pricing, availability, or discount information.

14. Limitation of Liability

To the maximum extent permitted by law, CardDeals LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service, any purchases made through third-party providers linked from the Service, or any unauthorized access to your account.

15. Indemnification

You agree to indemnify, defend, and hold harmless CardDeals LLC, its officers, directors, employees, and affiliates from any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your submitted User-Generated Content, your violation of these Terms, or your violation of any rights of a third party.

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, arbitration agreements, and limitations of liability.

17. Dispute Resolution: Binding Individual Arbitration & Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury hear your claims.

Informal Dispute Resolution: Before initiating any formal legal or arbitration proceeding, you and CardDeals agree to attempt to resolve any dispute, claim, or controversy informally. Either party must send a written notice of dispute detailing the issue, requested relief, and contact information to [email protected]. Both parties agree to engage in good-faith negotiations for at least thirty (30) days following receipt before initiating arbitration.

Binding Individual Arbitration: Except for small claims disputes that qualify for small claims court or claims seeking emergency injunctive relief for intellectual property or trade secret infringement, any dispute, controversy, or claim arising out of or relating to these Terms, the Service, or your relationship with CardDeals LLC shall be finally settled by binding individual arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules, or the Rules of Arbitration of the International Chamber of Commerce ("ICC") for international users, as applicable. The Federal Arbitration Act ("FAA") governs the interpretation and enforcement of this section.

Jury Trial Waiver: You and CardDeals knowingly, voluntarily, and irrevocably waive any constitutional and statutory rights to go to court and have a trial in front of a judge or a jury.

30-Day Right to Opt Out: You have the right to opt out of the provisions of this Arbitration Agreement within thirty (30) days of the date you first accept these Terms (or first use the Service) by sending written notice to [email protected] stating your name, account email, and an unequivocal statement that you wish to opt out of arbitration. If you opt out, all other sections of these Terms will continue to apply.

Severability: If any portion of this arbitration clause is found to be unenforceable or invalid, that specific portion shall be severed and the remainder shall remain fully enforceable, provided that if the Class Action Waiver is held unenforceable, the entire arbitration agreement shall be voidable.

18. Governing Law & Jurisdiction

These Terms and any dispute not subject to arbitration shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. To the extent court proceedings are permitted, you and CardDeals consent to the exclusive jurisdiction and venue of state and federal courts situated in Delaware. If you are a consumer in the EU/EEA or UK, this clause does not affect mandatory consumer rights under the laws of your country of residence.
